Acceptance of Terms

By accessing and using ZERBA's delivery management platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

ZERBA provides a comprehensive delivery management platform that connects merchants, drivers, and customers through cutting-edge technology and seamless user experience. Our services include:

User Accounts & Registration

To access certain features of our service, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your account information is accurate and up-to-date
  • Notifying us immediately of any unauthorized use of your account

You must provide accurate and complete information when creating your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

12. Limitation of Liability

In no event shall ZERBA, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for any damages arising from or relating to these terms or the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless ZERBA and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

This indemnification obligation will survive the termination of these Terms and your use of the Service.

14. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

15. Governing Law & Disputes

These Terms shall be interpreted and governed by the laws of Morocco, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Morocco, except that either party may seek injunctive relief in court to prevent irreparable harm.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
